Terms of service

The agreement between MLJ, SASU and any organizer or studio subscribing to PaperKeepsake. In force from September 4, 2026.

1. Acceptance

By creating an account, submitting the enquiry form or using any part of the PaperKeepsake service, you accept these terms on behalf of yourself and of the business you represent. If you do not accept them, do not use the service. The person accepting confirms that they are authorized to bind their business. These terms, together with the privacy policy and the legal notice, form the whole agreement between us and replace any earlier discussion or proposal.

2. The service

PaperKeepsake is a hosted web application for professional photo organizers and memory keeping studios. It records client archive projects, container inventories with photographic proof, numbered scanning batches with rescan queues, reusable person records, dated tagging with confidence notes, metadata write back in IPTC and XMP, project time logs, and the publication of a private family index in web and print booklet form. Access is provided through a standard web browser. Master image files remain in the storage you control unless you explicitly choose to store derivatives with us.

3. Accounts and eligibility

You must be at least eighteen years old and use the service for professional purposes. You are responsible for the accuracy of the account details you provide, for keeping credentials confidential, and for every action taken under your seats, including those of assistants and subcontractors you invite. Tell us promptly at jimenezjulien42@gmail.com if you believe an account has been accessed without authorization. Seats are named: two people may not share one seat.

4. Acceptable use

You agree not to use the service to store or distribute unlawful material, to upload content you have no right to process, to attempt to breach or probe the security of the platform, to resell access without a written agreement, to run automated load beyond documented API limits, or to reverse engineer the software. We may suspend an account that is causing harm to the platform or to other customers, and where circumstances allow we will contact you before doing so.

5. Subscriptions and billing

Three plans are offered and all prices are in US dollars, excluding any tax that may apply in your jurisdiction. Solo Organizer is $25 per month for one organizer seat. Studio is $59 per month for up to four seats and adds operator roles, time logs, the client portal and branded delivery documents. Team is $125 per month for up to twelve seats and adds subcontractor accounts, bulk import, API access, retention rules and a named onboarding contact. Subscriptions are billed monthly in advance on the anniversary of the day you started. A plan change takes effect at the start of the next billing period, with any difference prorated on the following invoice.

6. Cancellation and refunds

You may cancel at any time from account settings, without giving a reason and without penalty. The subscription continues to the end of the period you have already paid for and is not renewed after that. We do not charge an exit fee. Partial months are not refunded, except where the service has been unavailable for a prolonged period through our fault, in which case we will credit the affected days. Before an account closes you can export every project as a CSV catalog with tagged derivatives and a printable index. Closed accounts remain recoverable for sixty days, after which the data is deleted permanently.

7. Customer data and ownership

Every photograph, scan, note, person record and catalog entry you place in the service belongs to you or to your client. We claim no ownership over it, we do not use it for training models, for marketing or for any purpose beyond running the service for you, and we do not disclose it except where compelled by law. We process it as your processor, on your instructions, under the data processing terms attached to the subscription. You are responsible for having the permissions you need from the families whose material you handle.

8. Service availability and support

We target 99.9 percent monthly availability, measured excluding scheduled maintenance announced at least forty eight hours in advance. Maintenance is scheduled outside United States business hours wherever possible. Support is provided by email at jimenezjulien42@gmail.com, answered on business days, usually within one working day. Team plan customers receive a named onboarding contact for their first two projects. Backups are taken daily and restore paths are tested before each release.

9. Warranty disclaimer

The service is supplied as it is and as available. Beyond the commitments written in these terms, and beyond the warranties that mandatory law grants you and that cannot be excluded, we make no other warranty, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non infringement. We do not warrant that the service will be uninterrupted or free of every defect, and you remain responsible for keeping your own copies of master image files.

10. Limitation of liability

To the extent permitted by law, our total liability arising out of or relating to the service in any twelve month period is limited to the amounts you actually paid us in that period. We are not liable for indirect or consequential loss, for loss of profit, business, goodwill or anticipated savings, or for the loss or corruption of data to the extent it results from your failure to keep the independent copies described above. Nothing in these terms excludes liability for fraud, for gross negligence, or for any liability that cannot lawfully be limited.

11. Indemnity

You agree to indemnify and hold harmless MLJ, SASU, its director and its personnel against claims, damages and reasonable legal costs arising from material you upload without the necessary rights, from your breach of these terms, or from your unlawful use of the service. We will tell you promptly about any such claim and will not settle it without consulting you.

12. Changes to these terms

We may update these terms to reflect a change in the service, in our suppliers or in the law. Material changes are announced by email at least thirty days before they take effect, and continuing to use the service after that date means you accept the new version. If you do not accept a material change, you may cancel before it applies and we will refund any unused prepaid period.

13. Governing law and contact

These terms are governed by French law. Any dispute that cannot be settled amicably falls under the jurisdiction of the competent courts of Paris, France, without prejudice to any mandatory protection available to consumers in their country of residence.
